This Policy applies to all personal data collected through our website at alpha8.in, through our enquiry and contact forms, and through direct communications with our team. It should be read alongside our Legal Disclosures.

1. Who We Are

For the purposes of the Information Technology Act, 2000 and the Digital Personal Data Protection Act, 2023, Alpha8 Wealth acts as the Data Fiduciary in respect of personal data collected through this website.

2. What Data We Collect

We collect only the data necessary to respond to your enquiry and, where you choose to proceed, to deliver our services.

Data you provide directly:

  • Full name, email address, and phone number — submitted through our contact or consultation request form.
  • A brief description of what brings you to us — submitted as free text through our enquiry form.
  • An approximate band of total investable wealth — submitted optionally through a dropdown on our consultation form. This is used solely to ensure we direct your enquiry to a member of our team suited to your situation.
  • Your responses to our Investor DNA assessment — including answers to risk preference and financial goal questions. These are used to generate a profile result for your own reference and to assist in an initial conversation with our team.

Data collected automatically:

Our website may collect standard server log data including IP address, browser type, referring URL, and pages visited. This data is retained in aggregated or anonymised form and is not used to identify individual visitors. We do not use third-party advertising trackers.

3. How We Use Your Data

We process your personal data only for the following purposes:

  • To respond to your consultation request or enquiry, and to arrange an initial conversation with a member of our team.
  • To assess whether our services are appropriate for your circumstances, prior to any engagement.
  • To fulfil our obligations as an AMFI-registered Mutual Fund Distributor, including Know Your Client (KYC) requirements and record-keeping obligations where a client relationship is established, in accordance with SEBI (Mutual Funds) Regulations, 1996 and applicable AMFI guidelines.
  • To comply with applicable law, regulatory directions, or orders from a court, tribunal, or regulatory authority.

We do not use your data for marketing communications without your explicit consent. We do not sell, rent, or trade your personal data to any third party, under any circumstance.

4. Sensitive Personal Data

Under the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011, certain categories of information — including financial data such as bank account details or investment account credentials — are classified as Sensitive Personal Data or Information (SPDI).

Alpha8 Wealth does not collect SPDI through this website. Any detailed financial information required to facilitate a client engagement or KYC process is collected only after a formal relationship is established, through secure and separately governed processes, and in accordance with AMFI and SEBI requirements.

5. Sharing of Data

We do not share your personal data with third parties, except in the following limited circumstances:

  • Where required by law, regulation, or a valid order from a court, tribunal, or regulatory body, including SEBI or AMFI.
  • Where disclosure is necessary to prevent or investigate fraud, a breach of law, or a threat to physical safety.
  • To Asset Management Companies (AMCs), Registrar and Transfer Agents (RTAs), or KYC Registration Agencies (KRAs) strictly as required to process transactions you have authorised us to facilitate on your behalf.
  • To our technology service providers who host or operate our website and CMS, strictly for the purpose of service delivery and under contractual obligations of confidentiality. These providers do not have independent access to your data for their own purposes.

6. Data Retention

If your enquiry does not result in a client engagement, we retain your contact details for a period of 24 months from the date of last communication, after which they are securely deleted. This period allows us to respond if you return to us, and to maintain records of enquiries as a prudent business practice.

If a client engagement is established, your data is retained for the duration of the engagement and for a further period of five years thereafter, in accordance with the record-keeping obligations applicable to AMFI-registered distributors under SEBI (Mutual Funds) Regulations, 1996 and relevant AMFI circulars.

7. Security

We maintain reasonable security practices and procedures as required under the IT (SPDI) Rules, 2011, including access controls, encrypted data transmission, and restricted staff access to personal data. No transmission over the internet is entirely secure, and we cannot guarantee absolute security — but we take our obligations in this respect seriously and review our practices regularly.

8. Your Rights

Under applicable Indian law, including the Digital Personal Data Protection Act, 2023, you have the right to:

  • Access a summary of the personal data we hold about you and the purposes for which it is being processed.
  • Correct any personal data that is inaccurate or incomplete.
  • Withdraw your consent to processing, where processing is based solely on consent. Withdrawal will not affect any processing carried out prior to withdrawal, nor will it affect processing we are obligated to carry out under law.
  • Request erasure of your personal data, subject to any overriding legal or regulatory obligation we have to retain it.
  • Nominate a person to exercise these rights on your behalf in the event of your death or incapacity.

12. Governing Law

This Privacy Policy is governed by the laws of India, including the Information Technology Act, 2000, the Digital Personal Data Protection Act, 2023, and the IT (SPDI) Rules, 2011. Any dispute arising in connection with this Policy shall be subject to the exclusive jurisdiction of the courts in Chennai, Tamil Nadu.
